These Terms of Service ("Terms") govern your access to and use of the Cooking Timers app, website, and services (collectively, "the Service"). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Who We Are
Cooking Timers is operated by Michelle Long, doing business as Cooking Timers. Our contact email is support@cookingtimers.app.
2. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms.
3. Free and Paid Services
Cooking Timers offers both free and paid features. The cooking timers themselves are free to use without an account.
The "Libraries" subscription plan unlocks additional features including recipe scanning, saving recipes and meal plans, and syncing across devices. The Libraries plan is offered on two billing intervals: monthly at $2.99 per month, and annual at $24.99 per year (plus applicable taxes). Both plans renew automatically until cancelled.
4. Subscriptions and Billing
- Billing: Subscription fees are charged through Stripe. You agree to pay all fees associated with your subscription.
- Renewal: Monthly subscriptions renew each month and annual subscriptions renew each year, unless you cancel before the renewal date.
- Cancellation: You may cancel your subscription at any time through the "Manage subscription" button in the app. Cancellation takes effect at the end of your current billing period (monthly or annual), and you will continue to have access until then.
- Refunds: We do not provide refunds for partial months or unused subscription periods. Annual payments are not automatically refunded unless required by applicable law or by our support policy on a case-by-case basis.
- Plan changes: Existing monthly subscribers may switch to the annual plan at any time. Switching to annual does not trigger an immediate charge or proration — the new annual price takes effect on the next renewal date, and access continues uninterrupted through the already-paid period.
- Price changes: We may change subscription pricing with notice. Continued use after a price change constitutes acceptance of the new price.
5. Your Content
You retain ownership of any recipes, notes, scanned images, and other content you upload or create using the Service ("Your Content"). By using the Service, you grant us a limited license to store, display, and process Your Content solely for the purpose of providing the Service to you.
You are responsible for ensuring that Your Content does not violate any laws or the rights of others. Do not upload content you do not have the right to use.
6. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Interfere with or disrupt the Service or its servers
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated systems to access or scrape the Service without permission
- Upload malicious software, viruses, or harmful code
We may suspend or terminate your access if we believe you are violating these rules.
7. Intellectual Property
The Service, including its design, code, trademarks, and branding, is owned by Michelle Long and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our express permission.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Your use of the Service is at your own risk.
Cooking timers and recipe data are provided for convenience only. You are responsible for ensuring your food is cooked safely and properly. We are not liable for overcooked, undercooked, or unsafe food resulting from use of the Service.
9. Limitation of Liability
To the maximum extent permitted by law, Michelle Long (dba Cooking Timers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Michelle Long (dba Cooking Timers) from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at our discretion, particularly if you violate these Terms. Upon termination, your right to use the Service ceases immediately, though provisions related to intellectual property, disclaimers, and liability limitations shall survive.
12. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in California.
13. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms in the app with a revised "Last updated" date. Continued use of the Service after changes means you accept the updated Terms.
